Free template + step-by-step guide to appeal your visa refusal
✉️ What is this page? A complete guide to appealing a Schengen visa refusal — including a free letter template in English, French and Arabic. Based on EU Visa Code Article 32(3). MonVisaSchengen is not a legal advisor — for complex cases, consult an immigration lawyer.
⚠️ Important before you start: An appeal is not the same as a new application. You are formally challenging the consulate's decision. The appeal must address the specific refusal ground(s) stated on your refusal notice. Submitting an appeal with no new evidence or arguments rarely succeeds.
📋 Can I Appeal a Schengen Visa Refusal?
Yes. EU Visa Code Article 32(3) gives you the right to appeal a Schengen visa refusal. When your visa is refused, the consulate must provide written notification using the standard EU form (Annex VI) with the specific ground(s) checked.
You then have the right to appeal to the competent authority in the member state that refused your visa. The appeal procedure and deadline vary by country.
However: an appeal is different from simply reapplying. You are challenging the legal basis of the refusal. For most applicants, a stronger new application (with better documents) is often more effective than a formal appeal — unless you believe there was a clear error or injustice in the decision.

✅ Tips to Improve Your Appeal Chances
1
Address the exact refusal ground — do not write a general letter. The appeal must directly contest the specific ground(s) checked on your refusal notice.
2
Submit new evidence — an appeal without new documents is almost never successful. What new proof can you provide that you did not include the first time?
3
Be specific and factual — courts and administrative bodies respond to facts and evidence, not emotional arguments. State facts clearly.
4
Respect the deadline — check your refusal notice for the exact deadline. A late appeal is automatically rejected without consideration of its merits.
5
Consider a new application instead — for most applicants, a stronger new application with better documents is faster and more effective than a formal appeal, especially if the refusal was for missing or weak documents.
❌ Common Mistakes in Visa Appeal Letters
Copying the same documents — submitting the same documents that were already refused proves nothing new. Always add stronger or additional evidence.
Writing emotionally — "I have been waiting months and really want to visit my family" does not address the legal basis of the refusal. Courts need facts.
Wrong language — the appeal must be in the official language of the country, or accompanied by a certified translation. A French consulate appeal in Arabic alone may not be accepted.
Missing the deadline — always check the specific deadline on your refusal notice. The dates in our table above are general guides only.
Wrong authority — appeals go to different bodies depending on the country. Check where to send your appeal — it is not always back to the consulate.

❓ Schengen Visa Appeal — FAQ
Can I appeal a Schengen visa refusal?
Yes. EU Visa Code Article 32(3) gives you the right to appeal. You must receive written notification with the specific refusal ground(s). The appeal procedure and deadline vary by country — typically 30 to 60 days from refusal.
Is it better to appeal or reapply?
For most applicants, a stronger new application with better documents is faster and more effective. A formal appeal makes sense if you believe there was a clear error in the decision, or if you have significant new evidence that directly contradicts the refusal ground.
How long does a Schengen visa appeal take?
Appeal processing times vary by country and authority. Administrative court appeals can take several months. If you need to travel soon, a new application is usually faster than waiting for an appeal decision.
What language should the appeal letter be in?
The appeal must be in the official language of the country that refused your visa, or accompanied by a certified translation. For a French consulate, write in French. For a German consulate, write in German.
Does appealing affect my next visa application?
A formal appeal does not automatically affect future applications. However, if the appeal is rejected, future applications should address the same refusal ground with stronger evidence. Always declare previous refusals honestly — non-disclosure is itself a ground for refusal (Annex VI ground 16).
